Welcome to AutoSaber. The terms "we," "us," and "our" refer to AutoSaber, operated by Monty Bowden and Shahmir Shaheryar. AutoSaber operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). AutoSaber is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with our Privacy Policy and any other policies referenced herein, set out your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights, including areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use or access our Services.
These Terms are written in English and shall be interpreted in accordance with the laws of England and Wales.
Section 1 — Access and Eligibility
By agreeing to these Terms of Service, you confirm that you are at least 18 years of age, or the age of majority in your jurisdiction (whichever is higher). By placing an order you represent that you meet this requirement. You also confirm that you have given consent for any of your minor dependants to use the Services on devices you own or manage.
To use the Services — including browsing the store or making a purchase — you may be required to provide information such as your name, email address, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all necessary rights to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or licence your account to any other person.
Section 2 — Our Products
We make every effort to accurately represent our products and services. However, please be aware that colours and product appearance may differ from how they display on your screen, due to your device type, settings, and screen calibration. We do not warrant that the quality or appearance of any product will precisely match what is depicted in our store.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction on a case-by-case basis.
Under the Consumer Rights Act 2015, goods sold through AutoSaber must match their description, be of satisfactory quality, and be fit for purpose. Nothing in this section limits or excludes those statutory rights.
Section 3 — Orders and Contract Formation
When you place an order, you are making an offer to purchase. A binding contract is not formed until AutoSaber sends you a written order confirmation by email. We must receive and successfully process your payment before your order is accepted.
AutoSaber reserves the right to accept or decline any order at its discretion — including in cases of suspected fraud, pricing errors, product unavailability, or export restrictions. If we decline, cancel, or modify your order, we will endeavour to notify you at the email address, billing address, or phone number provided at the time the order was placed. Where an order is cancelled before dispatch, a full refund will be issued promptly.
Please review your order carefully before submitting. Once an order is accepted, we may be unable to accommodate cancellation requests. Your purchases are subject to return or exchange solely in accordance with our Refund & Returns Policy.
You represent and warrant that your purchases are for personal or household use and not for commercial resale or export in contravention of applicable law.
Section 4 — Prices and Billing
Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time your order is placed, as set out in your order confirmation email. Unless otherwise stated, prices do not include applicable taxes, import duties, customs charges, or shipping fees.
If an order is placed at an incorrect price due to a typographical error or system fault, we will notify you and give you the option to confirm the order at the correct price or cancel for a full refund. We are not obliged to fulfil orders at incorrect prices.
You agree to provide accurate, current, and complete payment and billing information for all purchases. You represent and warrant that: (i) the payment details you provide are true, correct, and complete; (ii) you are duly authorised to use the payment method; and (iii) charges will be honoured by your payment provider. You agree to update your payment information promptly where necessary.
Section 5 — Shipping and Delivery
AutoSaber ships from supplier warehouses in China to destinations worldwide. All delivery timeframes provided are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, public holidays, or events outside our reasonable control.
Once we transfer your goods to the carrier, title and risk of loss passes to you. For full details on delivery timeframes, tracking, customs duties, and lost or undelivered parcels, please refer to our Shipping Policy.
Section 6 — Intellectual Property
All content on the AutoSaber website — including but not limited to product images, text, graphics, logos, brand names, video, audio, product reviews, and the overall design and layout of the site — is owned by AutoSaber, its affiliates, or its licensors and is protected under the Copyright, Designs and Patents Act 1988 and applicable international intellectual property law.
These Terms permit you to use the Services for your own personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, download, store, or transmit any content from the Services without our prior written consent. All rights not expressly granted are reserved by AutoSaber.
AutoSaber's name, logos, and product names are trademarks of AutoSaber or its affiliates. Shopify's name and logo are trademarks of Shopify Inc. You must not use any of these marks without the prior written permission of the respective owner.
Section 7 — Third-Party Links and Optional Tools
The Services may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of any third-party site. Our inclusion of a link does not imply endorsement. If you access a third-party site from our store, you do so at your own risk.
You may be provided with access to optional third-party tools integrated into the Services. We provide access to such tools on an "as is" and "as available" basis, without warranties of any kind. We have no liability arising from your use of optional third-party tools. Use of such tools is subject to the terms of the relevant third-party provider.
Section 8 — Our Relationship with Shopify
AutoSaber is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through our store are made directly with AutoSaber. Shopify is not responsible for any aspect of any transaction between you and AutoSaber, including any injury, damage, or loss resulting from purchased products or services. By using the Services, you expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with AutoSaber.
Section 9 — Feedback and User Content
If you submit, upload, post, or otherwise provide any ideas, suggestions, feedback, reviews, proposals, or other content (collectively, "Feedback"), you grant AutoSaber a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including operating and improving the Services.
You represent that: (i) you own or have all necessary rights to any Feedback you provide; (ii) you have disclosed any compensation or incentives received in connection with it; and (iii) your Feedback complies with these Terms. We are not obligated to maintain confidentiality of Feedback, to pay compensation for it, or to respond to it.
We may monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, defamatory, pornographic, or otherwise objectionable, or that violates any third-party rights or these Terms.
You are solely responsible for any Feedback you submit. Your Feedback must not infringe any third-party rights, contain false or misleading information, or include viruses or malicious code.
Section 10 — Prohibited Uses
You may only use the Services for lawful purposes. You must not, directly or indirectly:
- Use the Services for any unlawful, malicious, or fraudulent purpose
- Violate any applicable international, national, or local law or regulation
- Infringe the intellectual property rights of AutoSaber or any third party
- Harass, abuse, harm, defame, or threaten any person
- Transmit false, misleading, or deceptive information
- Send unsolicited advertising, spam, or chain communications
- Impersonate any person or entity
- Upload or transmit viruses, malware, or any other harmful code
- Scrape, copy, extract, or exploit any part of the Services using manual or automated means, including robots, spiders, or AI agents
- Interfere with, bypass, or circumvent any security or authorisation feature of the Services
- Collect or track the personal information of other users
We reserve the right to suspend, disable, or terminate your account at any time without notice if we determine that you have violated any part of these Terms.
Section 11 — Automated Agents
This section applies if you use, allow, enable, or cause the deployment of an automated agent ("Agent") — meaning any software or service that takes autonomous or semi-autonomous action on your behalf — to access or interact with the Services.
No Agent may access the Services unless it: (i) identifies itself in all HTTP/HTTPS requests by including "Agent/[agent name]" in the request's user-agent string; (ii) does not conceal that access is from an Agent, including by mimicking human behaviour or circumventing CAPTCHAs; (iii) responds truthfully to any prompt seeking to determine whether interactions are from a human or a computer; and (iv) does not circumvent any measure we use to limit or control Agent access.
We may limit or block Agent access by technical or other means at any time. Any Agent access not in compliance with these requirements is a breach of these Terms.
Section 12 — Errors, Inaccuracies, and Omissions
There may occasionally be information on or in the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and to change, update, or cancel orders where information was inaccurate at the time the order was placed, at any time and without prior notice.
Section 13 — Disclaimer of Warranties
EXCEPT AS EXPRESSLY REQUIRED BY LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
Section 14 — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUTOSABER, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
AutoSaber's total liability to you for any claim arising in connection with these Terms or any order shall not exceed the total amount you paid for the relevant order.
Section 15 — Indemnification
You agree to indemnify, defend, and hold harmless AutoSaber, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims (including reasonable legal fees) arising out of or relating to: (1) your breach of these Terms or the documents they incorporate by reference; (2) your violation of any applicable law or the rights of any third party; or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim. A failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced as a result. We may control the defence and settlement of such a claim at your expense but will not settle any claim requiring non-monetary obligations from you without your consent.
Section 16 — Termination
We may terminate these Terms or your access to the Services (or any part of them) at any time, in our sole discretion, without notice. You will remain liable for all amounts due up to and including the date of termination.
The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and any other provisions that by their nature should survive termination.
Section 17 — Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed from these Terms without affecting the validity or enforceability of any remaining provisions.
Section 18 — Waiver and Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and AutoSaber with respect to your use of the Services and supersede all prior agreements and communications.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
Section 19 — Assignment
You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent; any such attempt shall be null and void. AutoSaber may transfer, assign, or delegate these Terms and its rights and obligations under them without your consent or notice.
Section 20 — Governing Law and Jurisdiction
These Terms of Service and any disputes arising in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You and AutoSaber agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause affects your rights as a consumer under the mandatory consumer protection laws of your country of residence. Customers resident in an EU Member State retain the benefit of mandatory EU consumer protection rights regardless of this clause.
Section 21 — Changes to These Terms
We reserve the right to update, change, or replace any part of these Terms at any time by posting the updated version to our website. We will notify you of any material changes in accordance with applicable law. The current version of the Terms, with its effective date, is always available on this page. Your continued use of or access to the Services following any changes constitutes your acceptance of the updated Terms.
